Client Agreement & Informed Consent

Important information about participation, safety, confidentiality, wellbeing and electronic consent when booking with Divine Aksara.

Please read this Agreement carefully before making a booking.

This Client Agreement & Informed Consent applies to individual sessions, group sessions, workshops and other services provided under Divine Aksara, operated by DIVINE CONSTELLATION EMPIRE, Malaysia.

By submitting a booking and completing the required electronic consent fields, you confirm that you have read, understood and accepted the applicable terms of this Agreement.

1. Nature of the Work

Divine Aksara provides systemic and family constellation work, facilitated reflective processes and related personal-development services.

Sessions may explore personal experiences, relationships, family dynamics, behavioural or emotional patterns, perceptions and other aspects of a Client’s life experience.

Constellation work may use symbolic, experiential or representative methods. Experiences or observations arising during a session are part of a reflective process and should not automatically be understood as objective facts about the Client, another person, a family member or past events.

Divine Aksara does not guarantee any particular interpretation, experience or outcome.

2. Not Medical or Psychological Treatment

Services provided by Divine Aksara are not medical, psychiatric or psychological diagnosis or treatment and are not a substitute for psychotherapy, counselling provided by a regulated healthcare professional, medical treatment, psychiatric treatment, legal advice or other regulated professional services.

Divine Aksara does not diagnose medical or mental-health conditions, prescribe medication or advise Clients to discontinue or alter treatment or medication prescribed by a qualified healthcare professional.

Clients should seek appropriately qualified professional assistance whenever medical, psychiatric, psychological, legal or other specialist advice is required.

3. Adults Only

Divine Aksara provides services only to persons who are 18 years of age or older.

By making a booking, the Client confirms that they are at least 18 years old.

Divine Aksara reserves the right to cancel or terminate a booking if it becomes apparent that the Client does not satisfy this requirement.

4. Voluntary Participation

Participation is voluntary.

During a session, a Client may:

  • decline to answer a question;
  • decline to participate in a particular exercise;
  • request a pause;
  • communicate discomfort or concern; or
  • choose to end their participation.

Clients are encouraged to communicate openly if they feel overwhelmed, unsafe or unable to continue.

Divine Aksara may also pause, modify, postpone or end a session where this is considered appropriate because of safety, wellbeing, suitability, professional boundaries or the circumstances of the session.

5. Client Responsibility

The Client remains responsible for their own choices, decisions and actions before, during and after a session.

Constellation work can create insights, impressions, emotions, images or interpretations. These should not automatically be treated as factual findings or as evidence concerning another person, a relationship, a family event, medical condition or historical event.

The Client agrees to exercise their own judgement when considering what a session means to them.

Significant medical, psychological, legal, financial, employment, family or relationship decisions should not be made solely on the basis of a constellation experience.

Where appropriate, Clients should obtain advice from a suitably qualified independent professional.

6. Existing Treatment and Relevant Health Information

For the purpose of supporting safe and appropriate participation, Clients are asked to inform Divine Aksara of any current medical, psychiatric, psychological, counselling or therapeutic care that may reasonably be relevant to their participation.

Clients should also disclose circumstances they reasonably believe may affect their ability to participate safely in emotionally intensive reflective work.

Clients are not asked to provide medical information that is unrelated to their participation.

Where Divine Aksara considers it appropriate, a Client may be advised to consult an existing healthcare or mental-health professional before participating or continuing.

Participation with Divine Aksara must not be used as a reason to discontinue, reduce, replace or alter prescribed medication, psychotherapy, psychiatric care, medical treatment or other professional care without consultation with the appropriately qualified professional responsible for that care.

7. Emotional Responses and Wellbeing

Constellation work may involve emotionally significant subjects.

During or following a session, a Client may experience unexpected emotions, memories, thoughts, bodily sensations or other personal responses.

Such responses vary between individuals and cannot be predicted.

Clients should communicate if an experience becomes overwhelming or if they believe they are unable to continue safely.

Divine Aksara does not provide emergency, crisis-intervention or acute psychiatric services.

A person experiencing an immediate medical or mental-health emergency should seek assistance from an appropriate emergency service or qualified healthcare professional.

8. No Guaranteed Outcome

Divine Aksara makes no guarantee that participation will produce a particular personal, emotional, relational, professional, financial, medical or therapeutic result.

Individual experiences differ.

Descriptions of possible insights, changes or benefits associated with constellation work describe possibilities only and do not constitute promises or guarantees.

9. Confidentiality

Divine Aksara treats personal information shared during sessions as confidential and handles such information with care.

Information will not ordinarily be disclosed to third parties without the Client’s consent.

However, confidentiality is not absolute.

Information may be disclosed where disclosure is required or permitted under applicable law, pursuant to a lawful court order or lawful request from a competent authority, where reasonably necessary to protect the safety of a person, or in other circumstances where Divine Aksara has a lawful basis for doing so.

Where disclosure is necessary, Divine Aksara will seek to limit the information disclosed to what is reasonably necessary in the circumstances.

10. Criminal Conduct, Abuse and Serious Safety Concerns

Divine Aksara does not offer confidentiality for the purpose of enabling or concealing ongoing or planned unlawful conduct, abuse, violence, exploitation or serious threats of harm.

Where information concerning actual or suspected criminal conduct, abuse, violence, exploitation or a serious risk to another person becomes known during the course of the work, Divine Aksara may take such action as is permitted or required under applicable law.

This may, depending upon the circumstances, include disclosure to an appropriate authority or emergency service.

Nothing in this Agreement means that every disclosure concerning past unlawful conduct will automatically be reported.

The appropriate response will depend upon the circumstances, the nature of the information and applicable legal obligations.

11. Group Sessions and Participant Confidentiality

Additional confidentiality responsibilities apply to group sessions, workshops and constellations involving more than one participant.

Participants agree to respect the privacy and dignity of every other participant.

Information learned about another participant during a group session must not be disclosed outside the group where that information is personal, private or sensitive.

This includes another participant’s personal history, family circumstances, relationships, health information, emotional experiences, statements made during the session and constellation content.

No participant may photograph, film, livestream, audio-record or otherwise record a session or another participant without prior express permission from Divine Aksara and every person affected.

Divine Aksara requires participants to respect these confidentiality obligations but cannot guarantee that another participant will comply with them.

12. Respectful Conduct and Safety

Every Client and participant is expected to behave respectfully and to respect the physical, emotional and personal boundaries of others.

Divine Aksara does not tolerate:

  • violence or attempted violence;
  • threats of violence or harm;
  • intimidation;
  • harassment or stalking;
  • abusive, discriminatory or degrading behaviour;
  • unwanted physical contact;
  • deliberate damage to property;
  • conduct creating a reasonable fear for another person’s safety;
  • possession or use of weapons during a session; or
  • serious disruptive behaviour that prevents a session from continuing safely.

Divine Aksara may immediately suspend or terminate a session where threatening, violent, abusive, harassing or otherwise seriously unsafe behaviour occurs.

Where reasonably necessary, Divine Aksara may require a person to leave, seek assistance from venue staff or security, contact emergency services or contact the relevant authorities.

A Client remains responsible for their own unlawful, intentionally harmful or seriously negligent conduct and for damage or injury for which they are legally responsible.

13. Alcohol, Drugs and Ability to Participate

Clients must not attend or participate while materially impaired by alcohol, recreational drugs or other substances in a way that makes safe or meaningful participation inappropriate.

Divine Aksara may decline to begin or may terminate a session if a Client appears materially impaired or otherwise unable to participate safely.

Prescribed medication should not be discontinued or altered for the purpose of attending a session.

14. Third Parties and Family Members

Constellation work may involve discussion or symbolic representation of family members, partners and other people who are not present.

Statements, representations, impressions or interpretations arising during a constellation relate to the Client’s reflective process within the context of that session.

They should not automatically be treated as factual statements, diagnoses or professional assessments of an absent person.

Clients are encouraged not to disclose unnecessary identifying or sensitive information about third parties.

Nothing in this Agreement is intended to restrict or remove legal rights independently belonging to a person who is not a party to this Agreement.

15. Personal Data and Privacy

Divine Aksara may collect and process personal information reasonably necessary to:

  • manage bookings and appointments;
  • communicate with Clients;
  • assess suitability for participation;
  • provide the requested service;
  • maintain appropriate administrative and consent records;
  • address legitimate safety concerns;
  • comply with applicable legal obligations; and
  • establish, exercise or defend legal rights where necessary.

Personal information will be handled in accordance with the Divine Aksara Privacy Policy and applicable Malaysian data-protection law.

Clients should provide only information that is reasonably relevant to their booking or participation.

16. Sensitive Personal Data

Certain information voluntarily provided by a Client may constitute sensitive personal data, including information concerning physical or mental health, medical or therapeutic treatment or actual or alleged criminal conduct.

Where Divine Aksara asks a Client to provide such information, it should be limited to information reasonably relevant to the purpose for which it is requested.

Where express consent is required for the processing of sensitive personal data, Divine Aksara obtains that consent separately from acceptance of this Agreement.

A Client’s acceptance of the general terms of this Agreement is therefore not intended to replace any separate express consent required for the processing of sensitive personal data.

17. Records and Electronic Communications

Divine Aksara may retain booking information, electronic consent records, relevant correspondence and information reasonably required for administration, legal compliance, safety and the provision of services.

Reasonable measures will be taken to protect personal information against unauthorised access, loss, misuse or disclosure.

Clients are responsible for providing accurate booking and contact information.

A Client should inform Divine Aksara where information previously provided becomes materially inaccurate or where circumstances relevant to safe participation change before a session.

18. Photography, Recording and Publication

Clients and participants may not photograph, film, livestream or audio-record a session without prior express permission from Divine Aksara.

Where another participant would be identifiable, that person’s permission must also be obtained.

Divine Aksara will not use an identifiable Client’s image, recording, testimonial, personal story or case material for public, promotional or marketing purposes merely because the Client agreed to participate in a session.

Any permission for identifiable promotional, testimonial or publication use must be obtained separately where required.

Consent to marketing or publication is separate from consent to receive services from Divine Aksara.

19. Right to Decline, Modify or Terminate Services

Divine Aksara reserves the right to decline, postpone, modify or terminate a session or other service where there are reasonable concerns relating to:

  • safety;
  • the Client’s ability to participate appropriately;
  • the suitability of the service;
  • professional or personal boundaries;
  • serious misconduct;
  • threatening or abusive behaviour;
  • material impairment;
  • circumstances in which Divine Aksara cannot appropriately provide the service; or
  • circumstances outside Divine Aksara’s reasonable control.

Where appropriate, Divine Aksara may suggest that the Client seek assistance from another suitably qualified service or professional.

20. Ordinary Risks of Participation

By choosing to participate, the Client acknowledges that emotionally reflective work may involve temporary emotional discomfort, uncertainty or intensity.

The Client voluntarily participates with this understanding.

This acknowledgement does not waive or remove any right or protection that cannot lawfully be excluded or restricted.

21. Responsibility and Liability

Divine Aksara is responsible for providing its services with appropriate care within the nature and scope of the service offered.

The Client remains responsible for independent decisions and actions taken outside the session.

To the extent permitted by applicable law, Divine Aksara is not responsible for loss arising solely from:

  • a Client acting on an interpretation or experience from a constellation as though it were established fact;
  • a Client making an independent decision contrary to advice received from their own qualified medical, psychological, legal or other professional adviser;
  • materially inaccurate or incomplete information supplied by the Client;
  • a Client’s expectation of a particular outcome where no such outcome was guaranteed; or
  • conduct of another participant that Divine Aksara could not reasonably have anticipated or prevented.

Nothing in this Agreement excludes, limits or modifies any liability, statutory protection or consumer right where such exclusion, limitation or modification is prohibited by applicable law.

22. Booking, Cancellation and Payment

Booking, cancellation, rescheduling, attendance, payment and refund arrangements are governed by the Divine Aksara Terms & Booking Policy communicated or made available at the time of booking.

Where those terms conflict with a mandatory right under applicable law, applicable law prevails.

23. Electronic Acceptance

This Agreement is provided electronically as part of the Divine Aksara booking process.

Before submitting a booking, the Client is required to confirm electronically that they:

  • are 18 years of age or older;
  • have had access to this Agreement before booking;
  • have read and understood the Agreement;
  • understand the nature and limitations of the services provided by Divine Aksara;
  • understand that constellation work does not replace medical, psychiatric, psychological or other regulated professional treatment;
  • understand that participation is voluntary;
  • understand that emotionally significant responses may occur;
  • understand that no particular result is guaranteed;
  • agree to respect confidentiality, safety and personal boundaries; and
  • voluntarily agree to participate subject to these terms.

Where relevant sensitive personal data is provided, the Client will be asked to provide the required separate express consent for its processing.

The Client’s electronic confirmations are recorded together with the relevant booking information.

Submitting a booking after completing the required consent fields constitutes the Client’s electronic acknowledgement and acceptance of this Agreement for the relevant booking.

A copy of the current Agreement remains available through the Divine Aksara website.

24. Governing Law

This Agreement is governed by the laws of Malaysia.

Nothing in this Agreement is intended to remove or restrict rights or protections that cannot lawfully be excluded under applicable Malaysian law.

25. Severability

If any part of this Agreement is found to be unlawful, invalid or unenforceable, that provision will be limited or interpreted to the minimum extent necessary where legally possible.

The remaining provisions will continue to apply.
